ARTICLE 29 - MEAL ALLOWANCE

29.01 From July 1, 2005 to June 30, 2007, each Resident who is required to remain in Hospital during scheduled duty periods over and above regular duty hours, as specified in sub-article 14.02, for a weekend day or weekday On-Call duty period shall be entitled to a daily allowance for meals, as outlined in this Article.

29.02   (i)    Resident Scheduled On-Call on Site

A daily meal allowance shall be paid to each Resident for each day the Resident is scheduled to be on call in the facility, whether a weekend day or a weekday.  The amount of the meal allowance shall be $10.35 per day.

(ii)    Resident On-Call off Site

If a Resident, while on call at home or outside of the Employer’s premises is required to return to the facility to carry out duties for at least three (3) hours then the Resident shall be entitled to a meal allowance of $4.00.  This allowance is payable for those return(s) of three (3) or more hours a Resident is required to return to the Hospitals, provided that:

  • (a) payments for an applicable call period do not exceed the daily meal allowance referred to in 28.02(i) above; and
  • (b) meal allowance shall be paid for the first return of three (3) hours or more regardless of when it occurs but other payments for meals to the stated maximum in (a) above shall be paid only if the subsequent return(s) to the Hospitals coincides with a normal meal period.

(iii)  Resident (Psychiatry) who remain on Site until 11:00 p.m.

Residents in this category shall receive a meal allowance of $4.00.

29.03 Administration of and payment for meal allowance referred to in sub-article 28.02 shall be in accordance with the following procedures:

  • (a)    When monthly call schedules are prepared, the Chief Resident shall record for each Resident shown on the call schedule the total number of days for which each Resident is scheduled to be on Call within the Hospital and this information, together with the call schedules, shall be forwarded to the Employer and to the Association’s offices.  This information shall be verified by a responsible official of the Employer.  The call schedule(s) received by the Employer is acknowledged as the document(s) by which meal allowances shall be paid;
  • (b)    For meal allowances payable to a Resident returning to the Employer’s premises from being on call outside of Employer’s premises, all as defined in 28.02(ii) above, a standard meal claim form shall be agreed upon by the Employer and the Association.  It shall be the responsibility of the Resident to fill out the form and have it verified by the appropriate Program Director or his designated representative for the purpose of confirming attendance at the Hospitals for the minimum required time.  These forms shall be forwarded to the appropriate office of the Employer and to the Association offices;
  • (c)    On or before the 15th of the month following the month for which the call schedules were published the Association shall forward to the Employer a master sheet showing the names of those Residents to whom meal allowance is payable for the preceding month.  Employees called in from off site shall not be included in the master sheet, but shall be shown on a separate list.  The master sheet shall show the name of each Resident, the total number of call days for which the daily meal allowance is payable, the daily meal allowance and a total amount owing to each Resident;
  • (d)    Within thirty (30) calendar days of receipt of the master list the Employer shall pay to each Resident the meal allowance owing;
  • (e)    Subject to correcting errors reflecting the number of call days for which allowance is payable, either at the instance of the Employer, the Association or Resident, the Employer shall be entitled to treat the Master List, based upon scheduled or actual in Hospital On-Call Duty, as being conclusive for the purpose of payment of meal allowance and the Employer shall not be required to make adjustments among individual Residents based upon interchange of call duty or a particular Resident having been absent from scheduled call duty for valid reason such as sickness or other leave of absence.  Rather, such adjustments shall be the responsibility of the Residents individually affected.

29.04 Effective July 1, 2007 entitlement to meal allowance pursuant to this Article shall cease and the Article shall be deleted from the Collective Agreement.
